A grand jury in Ontario County, NY has declined to bring criminal charges against three-time Sprint Cup champion Tony Stewart in connection with an on track incident that resulted in the death of another driver. Stewart, and 20-year-old Kevin Ward, Jr. became entangled during a night race at Canandaigua Motor Sports Park on August 9th. Ward spun into the wall, and the caution flag came out. Ward exited his race car, and walked toward the center of the track, gesturing angrily at Stewart, whose vehicle struck the young man, killing him. 

Ward's family blames Stewart for their son's death, stating they will "pursue all remedies." The complete statement reads as follows: "Our son got out of his car during caution when the race was suspended. All the other vehicles were reducing speed and not accelerating except for Stewart, who intentionally tried to intimidate Kevin by accelerating and sliding his car toward him, causing the tragedy. The focus should be on the actions of Mr. Stewart. This matter is not at rest and we will pursue all remedies in fairness to Kevin."

Fox Sports reports the family's civil case will be weakened by autopsy results indicating Ward was under the influence of marijuana while competing in the race.
