Louisiana THC Law Changes 2025

Instead of completely dismantling Louisiana’s edible hemp industry, lawmakers instead chose to much stricter regulations for 2025.

House Bill 952, sponsored by Rep. Dustin Miller, D-Opelousas, secured a 72-30 vote in the House and a 26-11 approval in the Senate during the last hour of the legislative session Monday.

"Miller’s legislation will, among other things, lower the potency of recreational hemp edibles from 8 milligrams to 5 milligrams of THC per serving and ban them from convenience stores that sell fuel.

THC is an acronym for tetrahydrocannabinol, the psychoactive compound in cannabis."

Existing Alcohol Establishments Can Keep Selling Hemp, but New Permits Halted

Louisiana restaurants and bars with current alcohol and hemp permits can continue selling hemp products.

However, the new bill prevents the state from issuing any additional hemp permits to alcohol-serving establishments.

Louisiana Bill Lowers THC Limits in Tinctures and Beverages

The new THC Bill reduces the potency of liquid THC tinctures from 80 milligrams to 30 milligrams and caps THC beverages at 5 milligrams per serving.

The law bans popular drinks containing 50 milligrams of THC per can, despite manufacturers advising single-serving consumption.

Hemp, while part of the same cannabis species as marijuana, contains very low levels of THC.

However, manufacturers of hemp-based consumable products can extract and concentrate these trace amounts of THC to create levels capable of producing an intoxicating effect.
