It's been less than 24 hours since the crippled Carnival Triumph arrived in port and the first lawsuit has already been filed.

Cassie Terry of Lake Jackson, Texas filed suit against Carnival Corp. on Friday. She's seeking unspecified damages. Terry's nine page complaint claims she feared for her life or that she might suffer serious injury or illness resulting from exposure to raw sewage and spoiled food. The suit alleges that, "the vessel listed sharply several times, causing human waste to spill out of non-functioning toilets, flood across the Vessel's floors and halls, and drip down the Vessel's walls."

All lawsuits against Carnival are required to be filed in Miami. Maritime attorneys say it's extremely difficult to win a case of this nature unless the plaintiff can show actual injury or illness.

A Carnival spokesman said the company hadn't seen the suit and declined to comment. The Triumph was disabled by an engine fire Last Sunday.
